A set of terms and conditions describes part of a digital service. To review the business, it is also necessary to understand what happens when a customer registers, orders, pays, receives the service or requests a refund.
For a marketplace, identify the platform, the customer, the underlying service provider and the payment provider separately. Trace who makes each promise, receives funds, performs the service and handles a complaint. A payment-gateway agreement should be read alongside those operational facts.
The same approach applies to information: what is collected, for what purpose, where it is stored and which vendors receive it? Bring the privacy notice, registration screens, vendor contracts and a description of the actual data flow.
Regulatory scope depends on the actual activity and relevant framework. A label in the interface, a disclaimer or a consent checkbox should not be treated as the conclusion of that review. Our preparation guide sets out the records and questions to assemble before discussing a launch or product change.
